Contesting Custody Proceedings
Former Real Housewives of Atlanta star Kim Zolciak is actively pushing back against accusations of child neglect brought forward by her ex-husband, Kroy Biermann. According to legal documents obtained by recent reports, the 47-year-old reality personality claims that a recent court decision, which saw her custody rights temporarily suspended, was reached without the testimony of essential witnesses.
Zolciak asserts that a family therapist, who had been subpoenaed to provide input, was absent during the hearing. Furthermore, she alleges that she was prevented from cross-examining the court-appointed attorney, thereby denying her the chance to challenge Biermann's narrative and dispute the lawyer’s recommendations regarding child custody.
Background of the Legal Conflict
The situation escalated earlier this month when a Georgia judge granted Biermann primary physical custody of their children. While the former couple maintains joint legal custody, the current order stipulates that Biermann holds the final decision-making power concerning the children’s education, religious upbringing, and non-emergency medical care.
In a previous public statement regarding the initial temporary ruling, Zolciak expressed her frustration with the process, noting:
«The senior judge’s decision from April 29 is temporary until we return to court as soon as possible when we will have the opportunity for a full hearing. The new order was the result of an alleged emergency motion filed by Kroy to ensure the matter was heard by a senior judge instead of our duly elected assigned judge.»
A History of Marital Strife
The legal battle between the pair began in May 2023 when Zolciak filed for divorce. Although there was a brief period of reconciliation, the couple resumed divorce proceedings later that summer. By March, Biermann had officially requested sole custody, alleging that Zolciak failed to manage basic parenting duties effectively.
Zolciak has consistently refuted these claims, characterizing them as a strategic attempt to damage her reputation. Regarding the allegations, she stated:
«These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. I spent five weeks away working on two TV shows to support my family and make sure my children are cared for — something I will never apologize for. I refuse to be bullied or have lies twisted into a narrative about who I am.»
As the legal process continues, Zolciak remains focused on securing a full court date, where she intends to present her side of the story and clear her name.
