Legal Petition for Sentencing Deferral
Carmine Agnello, the son of reality personality Victoria Gotti, has formally requested that a federal judge postpone the start of his 15-month prison sentence. The motion seeks to delay his surrender—originally scheduled for July 20—until September 18, citing a critical medical necessity: he is slated to donate a kidney to his mother.
Medical Necessity and Family Support
According to documentation submitted to the court, Victoria Gotti, daughter of the late Gambino crime boss John Gotti, is currently suffering from chronic kidney disease. Medical reports provided by two physicians confirm that a nephrectomy procedure is set for August 3. Victoria Gotti has previously expressed that her son is her only viable match for the life-saving transplant.
In a heartfelt letter to the presiding judge earlier this year, Victoria Gotti pleaded for leniency, requesting probation instead of incarceration for her son. She wrote:
“He is there to help anyone. He is kind and generous to a fault. He is giving me the GIFT OF LIFE.”
Prosecution’s Stance
Federal prosecutors have challenged the request. Officials noted that a previous attempt to delay proceedings for this same surgery did not result in the procedure taking place. Furthermore, Assistant U.S. Attorney Charles Kelly argued that the federal Bureau of Prisons possesses the necessary medical infrastructure to manage such procedures, stating that being a kidney donor does not represent an “extraordinary family circumstance” that would warrant a departure from sentencing guidelines.
Despite their objections, prosecutors indicated they might be open to a limited deferral of the start date until August 10. The court has yet to issue a final ruling on the matter.
